The short version. WellPad gives you calculated locations for Alberta legal land descriptions. They’re for finding your way, not for surveying, so check them before anything important depends on them. Use the free lookup like a person, not a script. API plans are billed monthly through Stripe, have a fixed number of lookups, and can be cancelled anytime.
1. Who these terms are with
These terms are an agreement between you and Southpaw Digital Labs Inc. (“we”, “us”), an Alberta company. They cover the WellPad app, the website at wellpad.ca including the web LSD Lookup, and the WellPad LSD API (together, “WellPad”). If you use WellPad for your employer or another organization, you accept these terms for them too.
Our Privacy Policy explains what data we collect and how we use it.
2. About the locations WellPad gives you
WellPad calculates the location of legal subdivisions (LSDs), quarter sections and sections from the Alberta Township System. Coordinates are approximate, usually the centre of the parcel. Well information in the app comes from public Alberta Energy Regulator (AER) data and may be out of date.
- WellPad is not a legal survey and must not be used to set boundaries or for regulatory filings.
- Always confirm a location before you dig, drill, build, or send people or equipment, and follow your employer’s site access and safety procedures.
- Don’t rely on WellPad as your only means of navigation or in an emergency.
WellPad is independent and is not affiliated with the Government of Alberta or the AER.
3. The WellPad app
The app includes a free trial of every Pro feature, then limited free use. WellPad Pro is a one-time purchase made through Google Play or the App Store. Those purchases, including refunds, follow the store’s terms. Your Pro purchase belongs to your store account and is restored when you reinstall the app on that account.
4. The web LSD Lookup
The web lookup is free with daily limits: 10 lookups a day without signing in, and 50 a day with bulk lookups when you sign in with Google. We may change these limits.
You agree not to:
- Use scripts, bots or other automated tools on the web lookup (use the API instead)
- Get around the limits, for example by creating extra accounts or clearing your browser to reset them
- Copy large parts of our data to build a database, product or service
- Interfere with, overload or try to break into WellPad or its servers
5. Your account
Signing in uses your Google account. Keep it secure; you’re responsible for what happens under your account. We may suspend or close accounts that break these terms. You can ask us to delete your account anytime (see Delete your data).
6. The LSD API
Plans and billing
- API plans are monthly subscriptions, billed in advance through Stripe in Canadian dollars, plus GST/HST where it applies. Current plans and prices are on the developers page.
- Your plan renews automatically each month until you cancel.
- Each plan includes a number of lookups per billing period. Unused lookups don’t carry over to the next period.
- When you reach your limit, the API refuses further lookups until your next billing period starts or you upgrade. There are no overage charges.
- Each correctly formatted LSD in a request counts as one lookup, including LSDs we have no location for. Badly formatted codes are rejected and don’t count.
Changing or cancelling your plan
- Use Manage billing on the developers page to change plans, update your card, see invoices or cancel.
- Upgrades take effect right away. You’re charged the prorated difference for the rest of the billing period, and your new allowance applies immediately.
- When you cancel, your plan stays active until the end of the period you’ve paid for, and then stops. We don’t refund partial months, except where the law requires it.
- If a payment fails, Stripe will retry it. If it still can’t be collected, we may suspend API access until it is.
- We may change plan prices or allowances. We’ll email you at least 30 days before a change affects your subscription, and you can cancel before it takes effect.
API keys
- Keep your API keys secret. Don’t put them in web pages or apps where others can read them. You’re responsible for all lookups made with your keys.
- If a key may have been exposed, revoke it on the developers page and create a new one.
- We may revoke keys or suspend access if they’re used in a way that breaks these terms or harms WellPad.
How you can use API results
- You can use the results in your own software, products and services, including showing them to your own customers and users.
- You may not resell or give away access to the API itself, share keys outside your organization, or use the API to copy our data in bulk to build a competing lookup database or service.
- Keep each request reasonable in rate and size, and follow any limits in the API documentation.
Availability and changes
We work to keep the API available but don’t guarantee it will always be up, error-free or without interruption, and there’s no service level agreement. We may add to or improve the API. If we make a change that breaks existing requests to /v1, we’ll email subscribers at least 30 days ahead, unless the change is needed right away for security or legal reasons.
7. Our content
WellPad, its software, design and the way we’ve compiled our data belong to Southpaw Digital Labs Inc. Public data we use, such as AER well data and the Alberta Township System, remains subject to its own terms. These terms don’t give you ownership of anything in WellPad, only the right to use it as described here.
8. Disclaimer
WellPad is provided “as is” and “as available”. To the extent the law allows, we make no promises about it, including that it is accurate, complete, fit for a particular purpose or uninterrupted.
9. Limit of liability
To the extent the law allows, Southpaw Digital Labs Inc. is not liable for any indirect, incidental, special or consequential losses, or for lost profits, revenue or data, arising from your use of WellPad or from inaccurate locations or data. Our total liability for any claim is limited to the amount you paid us for WellPad in the 12 months before the claim, or $100 CAD if you paid nothing. Some places don’t allow these limits, so they may not all apply to you.
10. Ending these terms
You can stop using WellPad anytime. We may suspend or end your access if you break these terms, or stop offering part of WellPad. If we stop offering the API, we’ll give subscribers at least 30 days’ notice and refund any prepaid time we can’t provide.
11. Changes to these terms
We may update these terms. The new version will show a new “Last updated” date. If a change materially affects API subscribers, we’ll email you at least 30 days before it takes effect. Continuing to use WellPad after that means you accept the new terms.
12. Governing law
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Alberta.
